Terms & Conditions

1. About these terms

This website is operated by Greater Construction (“we”, “us” or “our”).

These terms apply to your use of our website. By using the website, you agree to these terms to the extent permitted by law. If you do not agree, please stop using the website.

2. Website information

Our website provides general information about our construction services, projects, home designs and house and land packages.

We take reasonable care to keep information accurate and current. However, website content may contain errors or become outdated. Please contact us to confirm details relevant to your project before making commitments.

General website information is not a substitute for project-specific building, engineering, planning, legal or financial advice.

Nothing in these terms excludes our obligations concerning misleading or deceptive conduct.

3. Enquiries, quotes and building contracts

Submitting an enquiry or requesting a quote does not, by itself, create a contract for building work or reserve a property, package or start date.

Any estimate, quote or proposal we provide is subject to its stated scope, assumptions, conditions and validity period.

Building work and other contracted services will be governed by a separate agreement setting out the relevant scope, price, payment arrangements, responsibilities and other conditions. These website terms do not replace or change that agreement.

If there is a conflict concerning contracted work, the separate agreement takes priority, subject to applicable law.

4. Designs, images and packages

Unless expressly stated otherwise, designs, floor plans, photographs, illustrations and renderings on the website are indicative.

Images may show optional upgrades, landscaping, furnishings, fixtures or other features that are not included in the advertised scope or price. Dimensions and areas should be checked against the final project documentation.

The suitability of a design or package depends on matters such as site conditions, planning requirements, engineering, consent approvals and agreed specifications.

Where prices or availability are displayed, their stated inclusions, exclusions, GST treatment and conditions apply. Please obtain current written confirmation before relying on them. Website updates do not change an existing contract.

5. Acceptable use

You must use this website lawfully. You must not:

  • Attempt to gain unauthorised access to the website, its systems or data.
  • Introduce malicious software or interfere with website security or operation.
  • Use the website to send unlawful, abusive or misleading material.
  • Infringe another person’s intellectual property or privacy rights.
  • Use automated tools in a way that disrupts the website or accesses restricted information.

We may restrict access where reasonably necessary to address misuse or protect the website and its users.

6. Website content and intellectual property

Unless otherwise stated, website content—including text, branding, photographs and designs—is owned by us or used with permission.

You may view, download or print content for personal use when considering our services. This does not give you permission to reproduce it commercially, republish it or use plans or designs for construction.

Any wider use requires permission from the relevant rights holder, except where permitted by law.

7. Information and documents you provide

Please ensure information you submit is accurate to the best of your knowledge and that you have permission to share any plans, photographs or other materials.

You retain your rights in materials you provide. You permit us to use and share them only as reasonably necessary to respond to your enquiry, assess your project or deliver agreed services, subject to any confidentiality obligations and our Privacy Policy.

Providing materials does not give us unrestricted permission to publish them or use them for marketing. We will seek any necessary permission separately.

8. Privacy

We handle personal information as described in our Privacy Policy, available through the website footer.

9. External links

Our website may link to third-party websites for your convenience. Unless expressly stated, a link does not imply our endorsement.

We do not control third-party content or practices. Please review the relevant website’s terms and privacy policy before using its services.

10. Website availability and liability

We take reasonable care in operating the website but cannot guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance, updates or security reasons.

To the extent permitted by law, we are not responsible for losses caused by website interruptions or technical failures beyond our reasonable control. This does not exclude liability for our failure to exercise reasonable care or for obligations that cannot lawfully be excluded.

Nothing in these terms limits or excludes rights or remedies under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Building Act 2004 or any other applicable law that cannot lawfully be limited or excluded.

These website terms do not exclude warranties or obligations applying to our building work.

11. Changes to these terms

We may update these terms from time to time. Updates apply to website use after the revised terms are published and will be identified by the date above.

Changes to these website terms do not retrospectively change any separate agreement you have with us.

12. Governing law

These terms are governed by New Zealand law. Any dispute relating to these terms may be brought before the New Zealand courts or a tribunal with jurisdiction.
